Terms and Conditions
Orders placed via 1010.works are processed through our service postservice.at. 1010.works and postservice.at are brands of 1010 Works GmbH. The following general terms and conditions of 1010 Works GmbH apply.
This English translation is provided for convenience only. The German version is legally binding.
§ 1 Scope of Application
These general terms and conditions (GTC) apply to all service contracts between 1010 Works GmbH, Seitenstettengasse 5/37, 1010 Vienna (hereinafter "Operator") and the user regarding the provision of virtual office services and related services.
§ 2 Subject of the Contract
The Operator is, on the basis of a valid lease, the main tenant of the business premises at Seitenstettengasse 5/37, 1010 Vienna, and provides virtual office services there. The scope of services depends on the plan selected by the user:
- Basic: Business and postal address for establishing a legal entity, access to a designated mailbox on site, company nameplate
- Plus: Additionally scanning and digital forwarding of mail, mail forwarding within Austria, parcel acceptance
- Premium: Additionally forwarding of mail, RSb collection with power of attorney, worldwide mail forwarding, company nameplate
§ 3 Conclusion of the Contract
The contract is concluded through the order placed by the user and its acceptance by the Operator. Acceptance takes place through confirmation by email and activation of the service. Each user receives an individual service contract.
§ 4 Prices and Payment
The current prices are available on the websites of the Operator (postservice.at and 1010.works). All prices are exclusive of 20 % VAT. The fee is due in advance for the respective billing period (monthly or yearly). Payments are processed via the payment provider Chargebee.
§ 5 Contract Term and Termination
The contract is concluded for an indefinite period. Both parties may terminate the contract monthly in writing without stating reasons. With yearly payment, the notice period is one month to the end of the respective contract year.
The right to extraordinary termination for good cause remains unaffected.
§ 6 Right of Withdrawal
Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from this contract within fourteen days without stating reasons. The withdrawal period is fourteen days from the day the contract is concluded.
§ 7 Obligations of the User
The user undertakes:
- To provide only truthful information
- Not to use the business address for unlawful purposes
- To notify the Operator of any changes to their contact details without delay
- To collect mail at regular intervals if a mailbox has been assigned on site
- To comply with any house rules applicable to the property
§ 8 Liability
The Operator is liable without limitation for intent and gross negligence. For slight negligence, the Operator is only liable in the event of a breach of essential contractual obligations. Beyond that, the Operator assumes no liability whatsoever for the delivery of postal items.
The user is liable to the Operator for all damage resulting from improper handling or use of the premises contrary to the contract, caused by the user or their visitors.
§ 9 Data Protection
The Operator processes personal data of the user in accordance with the General Data Protection Regulation (GDPR). For details, please refer to our privacy policy.
§ 10 Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, provided the user is an entrepreneur.
Apart from the respective service contract, no verbal side agreements exist. Amendments or additions must be made in writing.
Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a permissible provision that comes as close as possible to its economic intent.
